Summary:

**This is an updated news release regarding the arrest of a previously wanted subject, 25 year old Justin B. Wood of Yachats. Wood had outstanding Lincoln County warrants stemming from an assault that occurred in Yachats, Oregon on May 10, 2012.

On June 5, 2012 around 1:00 pm a U.S. Forest Service law enforcement officer (LEO) stationed in Waldport, Oregon received a report from a U.S. Forest Service employee that a male adult was  seen walking on Forest Service Road 55 near mile post 12. Forest Service Road 55 is located in Lincoln County southeast of Yachats. The subject told the forest service employee he had been lost in the woods for a couple days. The U.S. Forest Service LEO contacted the subject and identified him as Justin Wood. Wood was taken into custody without incident on the Lincoln County warrants and transported the Lincoln County Jail and lodged on charges of Assault in the second degree; Assault in the third degree x 2; Assault in the fourth degree; Unlawful use of a weapon x 2; Tampering with physical evidence, Criminal Mischief in the second degree; Menacing and Theft in the third degree. His bail was set at $300,000.

On May 10th 2012, at about 11:30 p.m. Lincoln County Sheriff's Deputies investigated a report of an assault that occurred in the Yachats, Oregon area. During the initial investigation it was reported the victim, a 46 year old male was menaced with a handgun by a female subject, identified as Julie A. Hubeny, 54, of Yachats. The victim was then assaulted by three adult male subjects, two of the subjects were identified as Matthew G. Hubeny, 27, of Yachats and Justin B. Wood, 25, also of Yachats. A third subject was also identified as a person of interest in the investigation. The victim was transported by Ambulance to SPCH Hospital in Newport for treatment. It was determined victim suffered physical injury as a result of being struck with various weapons by multiple suspects.

On May 12th 2012 the Lincoln County Sheriff's Office with the assistance of the Oregon State Police SWAT team executed a search warrant at the home of Julie and Matthew Hubeny. Subsequently Julie Hubeny was contacted and taken into custody where she was lodged at the Lincoln County Jail on the charges of Unlawful Use of a Weapon, Pointing a Firearm at Another, and Menacing with a bail of $115,000.00.

On May 15th 2012 Felony Warrants for Matthew Hubeny and Justin Wood were obtained for the charges of Assault II; Assault III x 2; Unlawful Use of a Weapon x 2; Tampering with Physical Evidence, Criminal Mischief II, and Theft III.

On May 31st 2012 infromation was obtained that Hubeny, Wood, and a person of interest were at a residence in the area of Milepost 7 on Ten Mile Creek Rd, in Lane County. Lincoln County Deputies obtained a search warrant for this residence. At about 11:58 p.m. Oregon State Police SWAT team members were conducting surveillance on the residence and encountered a male subject with a rifle who was later identified as having been a person of interest in the investigation. SWAT team members shot this subject and he was pronounced dead at the scene. Refer to attached news release from Lt. Greg Hastings from the Oregon State Police.

Matthew Hubeny was taken into custody at the location on the outstanding warrant and transported to the Lincoln County Jail where he lodged. At this time Justin Wood has an active felony warrant for his arrest and has not been located. His photo is attached.
