On March 9, 2010 at about 2:10am, Lincoln County Sheriff’s Deputy Eric Sorby conducted a traffic stop on a white Jeep Grand Cherokee on Highway 20 near Milepost 10, east of Toledo, Oregon. Deputy Sorby observed the vehicle traveling west bound without a working license plate light. Deputy Sorby contacted the driver, Marcus Butler, 26, of Salem and observed signs of drug impairment. Deputy Sorby asked Butler if he would consent to field sobriety tests. Butler consented to the tests and failed them. Deputy Sorby took Butler into custody.
A search of the vehicle was conducted. Deputy Sorby located numerous Oxycontin pills in the vehicle. Butler advised Deputy Sorby that he did not have a prescription for the pills and had recently purchased them. The street value of the pills located was approximately $900.00. Butler was transported to the Lincoln County Jail where he was lodged on charges of DUII and Unlawful Possession of a Controlled Substance (Schedule II), following a drug recognition evaluation. Butler’s bail was set at $65,000.00.
