On September 8, 2009, at approximately 10:00 PM, a citizen called Lincom dispatch to report a possible DUII driver traveling north bound on Highway 101 near Depoe Bay. Deputy Boys of the Lincoln County Sheriff's Office responded to the area and located a vehicle matching the description given by the citizen. The vehicle was stopped and the driver, Michael S. Wallace Jr. - 31 years old, from Portland, Oregon, was contacted. Deputy Boys conducted a DUII investigation and arrested Wallace for this and for Driving While Revoked (suspended license) misdemeanor. Wallace was transported to the Lincoln County Jail and refused to give a breath test. Deputy Boys applied for and obtained a search warrant to seize Wallace's blood. A blood draw was taken.
Wallace was taken to the Lincoln County Jail and lodged for DUII (alcohol) and Driving While Revoked, his bail was set at $30,000. Wallace was also issued a citation for Refusal to breath test.
