On April 17, 2009 at approximately 1:32am, Lincoln County Sheriff's Sergeant Adam Shanks conducted a traffic stop on a blue Ford Explorer for Violation of the speed limit near the intersection of US Highway 101 and SE 23rd Street in Lincoln City, Oregon. During contact with the driver, 42 year old Bryon Kent Miller of Portland, Oregon, Sergeant Shanks detected the odor of alcohol and observed signs of impairment. Miller agreed to perform field sobriety tests. Following the tests, Miller was taken into custody for Driving under the influence of intoxicants and transported to the Lincoln City Police Department where he provided a breath sample of .19%. Miller was cited and released for one count of DUII. Miller received an additional citation for Exceeding the speed limit. Miller's vehicle was secured and left at the scene.
