On August 28, 2008 at about 3:10pm, Lincoln County Sheriff's Deputy David Hawley observed 28 year old Robert E. Clayton of Toledo driving a vehicle on Yaquina Bay Road near milepost 11. Deputy Hawley had prior knowledge that Clayton had a suspended driver license. Deputy Hawley contacted Clayton at a work shop in the 600 block of Bay Blvd in Toledo. During the contact, Clayton attempted to provide Deputy Hawley with a false name. Deputy Hawley requested a records check and learned that Clayton had an outstanding warrant out for his arrest.
Deputy Hawley took Clayton into custody and transported him to the Lincoln County Jail without incident. After noticing several signs of impairment, Deputy Hawley conducted a DUII investigation at the Jail. Clayton consented to perform one field sobriety test which he failed. Clayton also refused to take a breath test.
Clayton was arrested for Driving Under the Influence of Intoxicants, Driving While Suspended Felony, False Information to a Police Officer, Reckless Endangering and an Outstanding Warrant. Clayton violated terms of his probation and was lodged without bail.
