Summary:
On February 13th, 2008 at about 12:15am, Lincoln County Sheriff's Deputies Chris Miller and Ryan McPartlin responded to the Landmark Tavern, 111 Hwy 101 North, Yachats, Oregon regarding a complaint of a disturbance involving a handgun being fired in front of the establishment.
Upon their arrival, Deputies contacted an intoxicated male, identified as Allan E. Holiday, 55 of Waldport, Oregon. Holiday was detained, and an investigation revealed he had been in an argument with Thomas R. Deufel, 47 of Waldport earlier that night. After the argument, Holiday went to his house, obtained a loaded 9mm handgun, and confronted Deufel with the handgun concealed on his person.
Another argument insued, and Deufel took the handgun away from Holiday and took it outside of the bar where he fired it in the air twice until the gun jammed. Deufel turned the handgun over to Deputies and it was taken into evidence. Deufel had an outstanding warrant for his arrest from Klammath County, Oregon and he was arrested for the warrant. No charges were filed on Deufel in relation with this incident. No one was injured during this incident.
Holiday and Deufel were taken to the Lincoln County Jail. Deufel was lodged on the warrant, with no bail, while Holiday was lodged for Unlawful Use of a Weapon, Disorderly Conduct and Menacing. His bail was set at $37,500.
