Summary:
On February 14, 2008 at about 10:30pm, Lincoln County Sheriff's Deputy Eric Sorby stopped a Plymouth Voyager Van near Milepost 3 on Highway 34 due to the rear license plate being covered in mud and unreadable. Deputy Sorby contacted the driver, 60 year old Rolfe Hagen, of Alsea. Hagen was accompanied by his wife, Janet Hagen, age 58, and four other friends. Deputy Sorby detected a smell of Marijuana coming from inside the vehicle during his contact with Hagen at the driver's door. Deputy Sorby also detected an odor of alcohol coming from Hagen.
Deputy Sorby asked Hagen if he would perform field sobriety tests which he failed. Hagen was placed into custody for DUII. Deputy Sorby secured Hagen in the back of his patrol car and contacted Hagen's wife. Ms. Hagen became upset with Deputy Sorby and struck him in the chest. Deputy Sorby advised Ms. Hagen she was under arrest and she resisted. After a short struggle Deputy Sorby was able to place Ms. Hagen in handcuffs. Both subjects were transported to the Lincoln County Jail. Rolfe Hagen was charged with DUII and Recklessly Endangering after he registered a .09%BAC. His bail was set at $15,000.00. Janet Hagen was charged with Assaulting a Police Officer, Resisting Arrest, Interfering with a Police Officer and Harassment. Her bail was set at $45,000.00.
