Summary:
On June 15, 2007 at approximately 1:31am, Lincoln County Sheriff's Sergeant Adam Shanks was dispatched to a report of a prowler at a residence in the 100 Block of Breeze Street in Depoe Bay, Oregon. A homeowner at the location called 911 and reported he was detaining a male subject at gunpoint who was found trespassing in the back yard of the homeowner's residence. Oregon State Police Trooper Brian Fitch was called to assist with the incident.
While officers were en route to the location, the homeowner advised dispatchers that the subject had entered the homeowner's residence without permission. Trooper Fitch arrived on scene and detained the subject. Sergeant Shanks arrived shortly after and took 25 year old Justin James Stewart of Portland, Oregon into custody on charges of Criminal trespass in the first and second degree. During the investigation, Sergeant Shanks learned there were three residents inside the home at the time of the incident, one of which was a small child. Stewart was lodged in the Lincoln County jail on a $10,000.00 bail.
