Incident: DUII
Date Occurred: May 31, 2007
Time Occurred: Approximately 1:30 AM
Location: Hwy 101 at Kernville, OR

Summary:

On May 31, 2007 at about 1:30 AM, a Lincoln County Sheriff's Office deputy was on patrol in the area of Hwy 101 and Kernville, when he came upon a suspicious looking vehicle parked alongside the highway. The deputy made contact with a male subject in the drivers seat and from statements received, determined the driver had driven to that location from Lincoln City, about 20 minutes prior. The deputy noticed signs of impairment and started a DUII investigation. Robert Sean Zbinden, age 47, of Portland, OR, submitted to, and failed sobriety testing. Zbinden was arrested and transported to the Lincoln County Jail where he provided a breath sample showing his blood alcohol concentration to be 0.14%. Zbinden was lodged in jail with bail set at $7,500.00.

During the DUII investigation, the deputy determined that Zbinden's past driving record made his vehicle subject to seizure instead of the usual tow from the scene. Zbinden's vehicle was seized and towed to the Lincoln County Impound yard where it is being held for possible forfeiture to the county.
