Summary:
On February 3rd, 2007 at about 12:28 a.m., Lincoln County Sheriff's Deputy Lance Cummings attempted to conduct a traffic stop on a silver 2000 Nissan pick-up for minor traffic violations on SW Cedar Street near the intersection of SW Starr Street in Waldport, Oregon. The vehicle failed to yield and continued traveling until it pulled into a driveway in the 200 Block of SW Cedar Street. The driver of the vehicle, identified as Lee James Gadinas, age 46 of Waldport, Oregon, exited his vehicle and fled into his residence.
While attempting to negotiate Mr. Gadinas out of his house Deputy Cummings learned Mr. Gadinas had a suspended driver license. Deputy Cummings further detected signs that Mr. Gadinas was impaired. With assistance from Deputies Eric Gulbranson, David Boys and Eric Sorby, entry was made into Mr. Gadinas' residence. Deputies located and took him into custody for driving with a criminally suspended license and attempt to elude police. Mr. Gardinas was transported to the Lincoln County Jail.
Deputy Cummings conducted further investigation at the jail and arrested Mr. Gardinas for DUII as well. Upon being offered a chemical breath test, Mr. Gardinas refused to provide a breath sample. In addition to the above charges, Mr. Gardinas was issued citations for Failure to drive within lane, Fail to use turn signal and Refusing to provide a breath sample. His total bail was set at $22,500.00.
