Summary:

On November 8th, 2006 at about 1:39 a.m. Deputy Cummings conducted a traffic stop on a 2000 Nissan Frontier pick-up, bearing Oregon license plate XTR 763, driven by Lee J. Gardinas, age 46 of Waldport, Oregon, for speeding. Upon contact with Mr. Gardinas Deputy Cummings detected signs of impairment. Deputy Cummings conducted a DUII investigation and arrested Mr. Gardinas for Driving While Under the Influence of Alcohol. Mr. Gardinas was transported to the Lincoln County Jail where he provided a breath sample. Mr. Gardinas' BAC was measured at .08%.

Mr. Gardinas was lodged at the Lincoln County Jail and his bail was set at $7,500. Mr. Gardinas' vehicle was impounded.
